Duluth man charged for felony drive-by-shooting, other charges

A Duluth man faces multiple charges stemming from an incident on the 5400 block of Oakley Street in Duluth Sunday.

According to the criminal complaint, 43-year-old Justin Lee Miller was charged Tuesday with Dangerous Weapons – Drive by Shooting and Harassment Restraining Order violation, both are felonies. Miller was also charged with 5th degree drug possession.

According to authorities, officers investigated a shooting that occurred on the 5400 block of Oakley Street on Sunday afternoon.

Following an investigation, authorities learned that the homeowners had recently taken out a Harassment Restraining Order against Miller, prohibiting him from being within 1000 feet of the residence.

Officers responded to a call of a drive-by-shooting at approximately 4:14 p.m. When they arrived on scene they spoke with multiple witnesses who described a blue GMC pickup truck with a Minnesota license plate drive slowly down the street. According to the criminal complaint, the witnesses described a long gun pointing out of the window of the vehicle before the driver fired a single shot at the home on Oakley Street.

Upon further investigation, authorities said the license and registration came back registered to Justin Lee Miller.

The suspects nephew, who is a minor, was the only person home at the time of the shooting. The nephew told police he was sitting at his computer in his room when he heard a loud bang and the air conditioner in his room began smoking. The boy was not injured.

According to the complaint, officers located a bullet hole in the bedroom wall of the boys bedroom and located more bullet holes going through the leg of the bedframe. The report says a bullet hole was also located on the outside of the home. The report says officers found a metal jacket of the bullet on the floor of victim’s bedroom.

Miller was arrested without incident a short time later.

While Miller was being processed, officers say they located “a small bindle of a white crystalline substance” on the suspect. The substance tested positive for methamphetamine.
